SERVICES (Daily reports, no sharing, Ganalytics controls all content)

A Farmer's Market subscription provides the subscriber with access to daily analytics reports for the markets/products/crops to which he/she subscribes.  Each day's report is typically delivered late at night after the market close, and every effort is made to ensure reports are delivered well before the next market open.

Ganalytics takes protection of its work products very seriously.  Reports are uploaded to a private online subscriber area for which the subscriber will have a username, password, and individual access rights.  Subscriber can access the subscriber area and view the reports through a password-protected website or mobile application.  Subscribers may also download the reports as PDF files that will be watermarked with identifying information to discourage distribution and identify violators.

Ganalytics has complete control over the format, delivery method, and content of the services provided.  Ganalytics may change any aspect of the services at any time and without notice to subscribers.  In practice, Ganalytics will typically notify subscribers of any significant changes.

PAYMENT DATES (Auto-billed on the 1st of each month)

The initial subscription fee will be charged immediately upon purchase at a prorated rate for the remainder of the calendar month in which the subscription is purchased.  Absent a cancellation request, all subscriptions automatically renew monthly.  Each month's subscription fee will be automatically charged to the subscriber's credit card on the first day of its respective month.

CANCELLATIONS (Any time and hassle-free, effective following month)

The subscriber may cancel his/her subscriptions at any time.  Cancellations will take effect at the end of the term for which the subscriber has already paid.  The subscriber will retain access to the paid content through the end of the paid term, and his/her subscription will not renew thereafter.

RATE ADJUSTMENTS (Typically annually)

Ganalytics will typically adjust subscription rates annually each January, but Ganalytics reserves the right to increase rates at any time and for any reason.  Ganalytics will provide a minimum of two weeks notice before any rate increase.

LIMITATIONS ON USE (No sharing!!)

All information obtained through a subscription to Farmer's Market is solely for the individual subscriber's use.  Access to the content is limited to one end user per subscription.  If the subscriber is an entity, only one end user (an individual) may access the subscriber content per subscription, and the content may not be distributed, disseminated, or transmitted internally among employees and/or agents of the entity.  Further, the subscriber may not distribute, disseminate, or transmit the subscriber content to any third party and may not allow third parties access to the content or information derived from the content.

SERVICE DISRUPTIONS (Every effort to be timely, but stuff happens)

Farmer's Market relies on a vast amount of data from a wide variety of third party sources and an extensive technological infrastructure.  Every effort is made to deliver the reports in a timely manner, but given the inherent complexity, disruptions or delays from typical delivery times are always possible.  This includes the possibility of disruptions spanning multiple days.  In the event of a disruption, the reports will be delivered as soon as possible.  Neither Ganalytics nor our officers, principals, employees, or agents shall be liable to any person for any losses, damages, costs, or expenses (including, but not limited to, loss of profits, loss of use, direct, indirect, incidental, or consequential damages) resulting from any disruption, delays, or suspensions of service.  The foregoing shall apply regardless of whether a claim arises in contract, tort, negligence, strict liability, or otherwise.

RETENTION OF RIGHTS (Everything is proprietary and belongs to Ganalytics)

Ganalytics retains complete rights to all documents, data, and information made available through a subscription to Farmer's Market.  Subscribers are not entitled to any information about or access to the underlying methodologies, components, data series, variables, or other information used by Ganalytics beyond that which is provided in the reports.

BUSINESS & INVESTMENT RISKS OF LOSS (YOU are responsible for your own decisions, so be responsible!)

By subscribing to Farmer's Market, you fully understand and agree that all businesses and investment markets are subject to numerous implicit and explicit risks, none of which Ganalytics can control or influence.  You therefore acknowledge and agree that all business or investment decisions you may make, including decisions that take into account or rely on any information provided or made available by or from Ganalytics, are yours and yours alone and are made solely at your own risk.  You should be aware of all of the risks associated with trading and investing, and you should seek advice from an independent financial advisor before making any trading or investing decisions.

The risk of loss in trading can be substantial. You should therefore carefully consider whether such trading is suitable for you in light of your financial condition.  When trading on margin, you may sustain a total loss that exceeds the initial margin funds and any additional funds that you deposit with your broker to establish or maintain a position.  Before deciding to trade and/or invest, you should carefully consider your objectives, level of experience, and risk appetite.  The possibility exists that you could sustain a loss of some of, all of, or more than your initial investment, and therefore you should not trade or invest money that you cannot afford to lose.

You also agree to bear complete responsibility for your investment research and decisions and acknowledge that Ganalytics has not and will not make any specific recommendations to you or any of its subscribers upon which you or any of them is entitled to rely.  You also understand that the information disseminated on this website or as part of the Services represent impersonalized, disinterested opinions, and commentary of Ganalytics and its employees and agents or may only represent the views of other subscribers or visitors, but that none of them constitutes a solicitation or recommendation to buy or sell a particular investment.

REGISTRATION (Ganalytics is not subject to most financial regulatory requirements)

You understand that Ganalytics is not registered or licensed with any state or federal agency, such as the Securities and Exchange Commission (“SEC”) or the Commodity Futures Trading Commission (“CFTC”).  Further, you understand that Ganalytics is not a member of any financial services industry self-regulatory organization, such as the National Futures Association (“NFA”) or the Financial Industry Regulatory Authority (“FINRA”).  Because of this, you understand that Ganalytics is not subject to many of the regulatory requirements that are applicable to registered or licensed financial participants.

GANALYTICS TRADING ACTIVITY (We may trade or invest in related products)

Ganalytics, its affiliates, and/or its personnel may trade or invest in some of the investment products which may be discussed in the subscriber content.  In certain instances, Ganalytics, its affiliates, and/or its personnel may hold opposite positions in the investment products than the positions commented on or inferred from the content.

CHOICE OF LAW, VENUE (Don't share/redistribute unless you want to be sued in New Jersey)

A subscription to Farmer's Market constitutes an Agreement to these Terms of Service between you and Ganalytics.  This Agreement will be governed by the laws of the State of New Jersey without giving effect to the conflicts of law provisions thereof.  You agree that any dispute with respect to this Agreement shall be subject to the exclusive jurisdiction of the State courts located in Monmouth County, New Jersey (or the Federal District Court closest to Monmouth County, New Jersey) and courts with appellate jurisdiction therefrom, and you hereby submit to the personal jurisdiction of such courts over you and expressly waive any claim of improper venue and any claim that such courts are an inconvenient forum.  You acknowledge that a breach of any provision of this Agreement would cause Ganalytics irreparable injury and damage not remediable through monetary damages.  Accordingly, you hereby waive any requirement for the securing or posting of any bond or other security or the showing of actual monetary damages or that money damages would not afford an adequate remedy in connection with a claim for equitable relief in relation to any such breach, threatened or actual, and such right shall be in addition to, and not in lieu of, any other rights and remedies available to Ganalytics at law or in equity.  In the event that Ganalytics is the prevailing party in any action brought under this Agreement, you agree that Ganalytics Party shall be entitled to reimbursement from you for any expenses incurred in connection with such proceeding (including reasonable attorney's fees, disbursements, costs of court, and costs of litigation, if any).
